This is an appeal by the plaintiff in the matter of an action of tort brought by the plaintiff against the defendant as a result of injuries received at the hands of *130another patron of the defendant’s place of business. In December, 1975, the defendant owned and operated an establishment known as The Red Bam in which alcoholic beverages were served and entertainment provided for the general public.
