This case was first before us in Frericks v. General Motors Corp., 274 Md. 288, 336 A. 2d 118 (1975). Briefly the facts are as follows. On September 21, 1970, John Frericks was a passenger in a 1969 Opel Kadett which was being driven by Ronald B. Baines. Near Jacksonville, North Carolina, Baines apparently fell asleep at the wheel, and the car left the road and overturned.
