MEMORANDUM OPINION
KAY, United States Magistrate Judge.
Pending before the Court are the Defendant’s motion for summary judgment (“Def.Mot.”)[20], the Plaintiffs’ opposition (“P1.0pp’n”)[25], and the Defendant’s reply (“Def.Reply”)[27], as well as the Plaintiffs’ motion for summary judgment (“PL Mot.”)[21], the Defendant’s opposition (“Def.Opp’n”)[24], and the Plaintiffs’ reply (“Pl.Reply”)[29j.
