Plaintiff Patrick Gottsch ("Plaintiff" or "Gottsch") brings this action for breach of contract and breach of fiduciary duty against Defendants Eaton & Van Winkle LLP ("EVW"), Martin Garbus, and Vincent McGill.1 Defendants now move pursuant to Federal Rules of Civil Procedure 12(b)(6) and 56 to dismiss the First and Second Causes of Action asserted in the Complaint (docket entry no. 1, the "Compl.").2 (Docket entry no. 18.)
