This is an appeal from a decree of the superior court setting aside a mortgage foreclosure sale and enjoining further prosecution of a pending action at law brought by the mortgagee’s executrix against the mortgagors, the present complainants, for a deficiency. The cause was heard in the superior court on bill, answer and proof. The complainants did not offer any evidence but rested on their sworn bill. On the allegations therein and the respondents’ evidence the trial justice held that the sale was not fair and just and should be set aside on the authority of Hanley v. Brayton, 60 R. I. 101,…
