The appellant was convicted in the circuit court of Vernon county of an-assault on one Jessie (Stucker) Hill, his divorced wife, with intent to kill, using a pistol loaded with powder and leaden balls. The crime is a felony punishable under Sec. 4408 1 by “not less than two years” imprisonment in the penitentiary. The maximum punishment is therefore life imprisonment. Sec. 4850.
