Defendant-Appellant Juan Ignacio Sa-nin appeals from a decision of the United States District Court for the Southern District of New York (Miriam Goldman Ce-darbaum, Judge) denying Sanin’s motion, made pursuant to 28 U.S.C. § 2255, to vacate his conviction and sentence. On appeal, Sanin contends that the Supreme Court’s decision in Gray v. Maryland, 523 U.S. 185, 118 S.Ct. 1151, 140 L.Ed.2d 294 (1998), constitutes a new rule of constitutional law which requires us to set aside his conviction and order a new trial.
