Defendant was charged in tbe county court of Garfield county with tbe unlawful possession of intoxicating liquor, to wit: 60 pints of wbisky; was tried, convicted and sentenced by tbe court to pay a fine of $100 and serve 60 days in tbe county jail, and bas appealed.

Eleven assignments of error are made, but only two are relied upon:(1) That tbe court erred in refusing to sustain tbe motion of tbe defendant to suppress tbe evidence for the reason that no search warrant was had by tbe officers at the time of finding tbe whisky in defendant’s automobile.(2) That tbe court erred in refusing to…
