APPEAL from the Decatur Circuit Court.

1Per curiam

Assumpsit by Springer against McKirmey for work and labor done and materials furnished, in and about the building of a house. The defence involved questions upon the statute of limitations, the breach of a special contract, and the amount recoverable on the common counts. The suit was commenced in 1844, and resulted, on the first trial, in a judgment for the plaintiff for 1,141 dollars and 65 cents.

That judgment was reversed in this Court in 1847, and the cause remanded for another trial. McKinney v. Springer, 8 Blackf. 506.
