HOLT, Justice.

Defendant appeals from the order overruling its demurrer to the amended complaint. The substance of the allegations of the pleading may be stated thus:

Plaintiff is a taxpayer of the city of St. Paul, and the action is brought in behalf of all the taxpayers thereof to recover the damages sustained by the city from the unjust discriminatory rates which the city has paid defendant for the electric current furnished by it to the city.
