This action is brought to impress a trust in favor of the plaintiff on two parcels of property located in the city of Buffalo, and to have the plaintiff declared the equitable owner of the same. The facts as shown by the evidence are substantially as follows:
*608The plaintiff was the husband of Ray Kushlowitz, who died intestate on the 23d day of October, 1927.
