Appeal by the plaintiff, Aaron M. Weigert, from a judgment of the Supreme Court in favor of the defendants, entered in the office of the clerk of the county of Kings on the 24th day of July, 1911, upon the decision of the court, rendered after a trial at the Kings County Special Term, dismissing the complaint upon the merits.

Burr, J.:

Plaintiff was married to Flora Schlesinger on August 21, 1892. She died September 30, 1910, intestate, leaving her surviving as her only heirs at law the defendants William Schlesinger, Frank Schlesinger, Frederick Schlesinger and Solomon Jacobs.

On August 13, 1903, plaintiff entered into a contract for the purchase from one Mninie E. Adams of property "at the *766corner of Bay parkway and Benson avenue.
