PELPHREY, Chief Justice.

Prior to September 17, 1924, appellee was the owner of lots Nos. 14, IS, and 16, in block No. 29, and lot No. 18, in block No. Ill, Campbell’s addition to the city of El Paso, Tex. On that date he executed and delivered his seven promissory notes aggregating the sum of $3,175, to the First Mortgage Company of El Paso, Tex.; the first four notes being in the principal sum of $400 each, the fifth and sixth being for $500, and the seventh being for $575.
