Came on before the Court Defendants’ Motion to Dismiss, or in the Alternative, Motion for Summary Judgment. This action comes before this Court as a tort claim arising under 28 U.S.C. § 1346, whereby the Plaintiff alleges that threats and other forms of harassment persisted during, his incarceration at the Federal Correctional Institution in Texarkana, Texas from May 19 through July 13, 1982.
