Defendant appeals as of right the trial court’s decision on remand, which found that defendant’s Sixth Amendment right to an impartial jury drawn from a fair cross section of the community was not violated because African-Americans were not underrepresented in the venire from which defendant’s jury was selected and Kent County’s jury-selection process, at the time of defendant’s trial, did not system*264atically exclude African-Americans. For the reasons set forth in this opinion, we reverse and remand for a new trial.
