MORROW, Presiding Judge. —
The offense is murder; penalty assessed at confinement in the penitentiary for thirty years. ". Appellant worked at night at the Eagle Cafe in Port Arthur, Texas. The deceased worked in the day time at a barber shop. situated a short distance from the cafe. About two o’clock in the morning the deceased entered the cafe. He engaged in a quarrel with the appellant which resulted in a fist fight on the outside of the cafe.
