Merchants Matrix Cut Syndicate, Inc., brought suit in the United States District Court for the Northern District of Illinois seeking recovery under the Federal Tort Claims Act, 28 U.S.C. § 1346 (b) for damages alleged to have been caused by the wrongful, wilful, and negligent acts of the officers and employees of the General Services Administration “and the officers, employees and agents of Clark-Congress Corporation.” But of the latter, Merchants expressly alleged: “Clark-Congress Corporation has not been made a party defendant herein, as it has been previously sued…
