This action was commenced in the Court below by the appellants, Morgan and Mildred Cryer, to recover and have set apart to them, one equal eighth part of three-fourths of a league of land, to which they allege they are entitled as heirs at law of George Duty deceased. There was an agreed state of facts, and the cause submitted to the Court, a jury being waived, and judgment for defendants, from which plaintiffs appealed.

George Duty, a citizen of the Republic of Texas, departed this life, in the fall of 1837, leaving, as a portion of his estate, three-fourths of a league of land lying in the county of Fayette, and as his heirs, several brothers and sisters and their descendants, among whom was his sister Mildred Cryer, wife of Morgan Cryer, then and now residing in the State of Arkansas.
