This is an appeal from a judgment of conviction entered in the United States District Court for the Eastern District of New York, Dearie, J., dated January 7, 1987, following a jury trial for conspiring to distribute cocaine, in violation of 21 U.S.C. § 846 (1982). Cruz claims that the district court should have granted his motion to suppress certain post-arrest statements and evidence found during a search of his truck following a de facto arrest without probable cause.
