The New York, Chicago and St. Louis Eailroad Company, hereafter referred to as the defendant, has taken this appeal from a judgment in the amount of $40,000 entered on the verdict of a jury in favor of Frank Hack, hereafter referred to as the plaintiff, in a personal injury action brought under the Federal Employers’ Liability Act (45 U.S.C.A., secs. 51-60).
