This consolidated case involves both an appeal and a petition for an extraordinary writ arising out of the same underlying merits appeal to this Court. The appeal is from a June 22,1999, decision of the Board of Veterans’ Appeals (BVA or Board) that held that VA did not have the authority to pay attorney fees to the appellant where all past-due benefits had already been paid to the veteran. The petition seeks a writ of mandamus to compel the Board to issue a final decision on his claim for attorney fees.
