In April, 1952, the police commissioner of the City of New York, after a hearing before one of his deputies, dismissed the petitioner from the position of patrolman in the police department. By notice of motion returnable in August, 1952, the petitioner instituted this proceeding under article 78 of the Civil Practice Act, in which he sought an order annulling the determination of the commissioner and directing the petitioner’s reinstatement to his former position with retroactive compensation, “ and directing that this proceeding be transferred for disposition to the Appellate Division of…
