The plaintiff, Boynton Land, Mining & Investment Company, brought this action against the defendant, Chas. F. Runyan, under the provisions of section G094, Comp. Laws 1909, to vacate and set aside a judgment after the term at which it was rendered, and for a new trial of the case in which the judgment was rendered. In the original action the defendant here, Chas. F.
