JACOBS, Justice:

The Republic of Panama and The State of Sao Paulo, Brazil (the “Foreign Governments”) brought actions in the Superior Court against various manufacturers and distributors of tobacco products (the “Tobacco Company Defendants”). Certain Tobacco Company defendants moved to dismiss the complaints under Superior Court Civil Rule 12(b)(6) for failure to state a claim upon which relief could be granted. 1 In a well-written opinion and order dated July 18, 2006, the Superior Court granted the motion and dismissed the complaints as to all Tobacco Company Defendants. 2 The Foreign…
