CURLEY, PJ.
¶ 1. Forrest Andre Saunders appeals the judgment convicting him of one count of burglary, contrary to Wis. Stat. § 943.10(lm)(a) (2009-10).1 He also appeals the order denying his postconviction motion. Saunders argues that at trial the prosecutor— contrary to Wis. Stat. § 971.23(8)(a), Wisconsin's notice of alibi statute — improperly commented on the fact that a man named Paul, at whose house Saunders claimed to be during the burglary, did not testify at trial.
