This is an original proceeding brought by Shell Oil Company in this court, to review an award made by the State Industrial Commission to claimant, Hurshell L. Thomas. Petitioner contends that the Industrial Commission erred in finding: (a) That petitioner had actual notice of claimant’s injury and was not prejudiced by the failure of claimant to give written notice of the injury within thirty days from the date thereof; (b) in finding that an accident occurred which injured claimant while he was in the employ of petitioner at the time and place claimed by claimant.
