In this congressional reference case,1 the review panel is faced with defendant's challenge, on legal and factual grounds, to the Report and Opinion of the Hearing Officer which concluded that plaintiff, The Merchants National Bank Of Mobile (Merchants), has an equitable claim against the *2United States in the amount of $809,609 for losses Merchants sustained in lending money to a government contractor pursuant to two successive loan guarantee agreements with the United States.2
