The action is at law, and the plaintiff alleges in his petition that on the 6th day of February, 1893, the comptroller of ihe currency, having become satisfied of the insolvency of the national banking association known a,a ihe Bankers’ & Merchants’ National Bank of Dallas, Tex., appointed H.
