WALLACE, Circuit Judge.

This is a writ of error by the plaintiff m the court below to review a judgment for the defendant upon a demurrer to the complaint.

The action was brought to recover penalties incurred, as is alleged, under section 3 of the act of Congress of March 3, 1891, entitled “An act in amendment of the various acts relative to immigration and the importation of aliens under contract or agreement to perform labor.” 26 Stat. 1084, c. 551 [U.
