W. D. Payne, hereinafter referred to as plaintiff, instituted four separate actions in the district court of Pontotoc county against the Northern Assurance Company of London, the American Central Insurance Company, Commercial Union Assurance Company, and the Phoenix Insurance Company, to recover losses sustained by a fire. Separate policies of insurance had been issued by each of the defendant companies covering certain portions of the property destroyed.
