Appeal from a judgment of conviction for the crime of murder in the second degree.

On October 6, 1964, at about 4 p. m., defendant, Vernon Hanson, shot and killed his wife, Rosella, at Browns Valley, Traverse County, Minnesota. The weapon used was a .22-caliber rifle which was found to contain 13 rounds of .22 “longs” after the fatal shot had been fired. When the gun was fired by Hanson, he was standing in the yard adjacent to a house owned by Donald Nickolauson of Browns Valley. Mrs. Hanson at that moment was at the kitchen doorway of the house.
