This is an appeal by Delbert M. Potter, hereinafter called defendant, from a judgment in favor of Home Owners’ Loan Corporation, a corporation, hereinafter called plaintiff, foreclosing a certain mortgage. The situation shown by the record is as follows:

Plaintiff filed its complaint in the superior court of Greenlee county alleging the character of the parties, and that defendant had on April 21, 1934, executed a note in favor of plaintiff in the sum of $6,997, and secured the same by a mortgage on certain real estate in Greenlee county.
