Appeal from a judgment of the County Court of Greene County (Battisti, Jr., J.), rendered November 24,1981, upon a verdict convicting defendant of the crimes of grand larceny in the third degree (one *630count) and attempt to evade tax (two counts). 11 Defendant was employed by the Greene County Memorial Hospital. The hospital, which had a radiology department, reclaimed silver flake from used and defective X-ray film. Defendant was in charge of that program.
