Plaintiff instituted an action against the defendant, the First State Bank of Cheyenne, Okla. His petition alleges that he had several transactions with the bank, and that on each of said transactions he was charged usury; that the several notes plaintiff had previously executed were all finally, merged in one note, and that usury was charged on said note, and that said note was secured by chattel mortgage on certain property of the plaintiff; that plaintiff had actually received in cash on these various transactions the sum…
