OPINION
KAPLAN, District Judge.
In 1977, defendant’s predecessor in interest purchased the Thomas Y. Crowell book publishing subsidiary (“Crowell”) of plaintiffs predecessor in interest, Dun-Donnelly Corporation. 1 Among Crowell’s publications at the time of the purchase was Dun & Bradstreet’s Guide to $Your Investments$: 19XX (the “Guide ”), which has been revised annually with the appropriate year substituted in the title.
