OPINION

The action below was one for personal injuries. The cause come on for trial to the court and jury, resulting in a verdict in favor of the plaintiff for five thousand dollars. A motion was made at the conclusion of plaintiff’s evidence for a directed verdict which motion was by the trial court overruled, and a like motion made at the conclusion of all the evidence which motion was likewise overruled.
