MEMORANDUM OPINION

LAMBERTH, District Judge.

This matter comes before the Court on the defendants’ motion to dismiss and motion for summary judgment, and the plaintiffs’ cross-motion for summary judgment. The defendants’ move to dismiss pursuant to Rule 12 of the Federal Rules of Civil Procedure. The defendants and plaintiffs both move for summary judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure on the ground that no genuine issue of material fact exists and therefore they, respectively, are entitled to judgment as a matter of law.
