DALTON, Chief Judge.
This case comes before the court upon a petition for a writ of habeas corpus filed pursuant to 28 U.S.C. § 2241, by James Thacker, a state prisoner, and it is filed in forma pauperis.
Respondent is now detaining petitioner pursuant to a judgment of the Circuit Court of Wise County of April 24, 1962, wherein petitioner was sentenced to serve a term of life imprisonment, having been convicted of murder in the first degree.
