OPINION
WIDENER, District Judge.
This proceeding comes before the court on a petition for habeas corpus filed in forma pawperis by Fred Douglas Via, a prisoner of the State of Virginia, pursuant to the provisions of 28 U.S.C. § 2241.
Petitioner is presently serving a 20-year sentence in the Virginia State Penitentiary, following his conviction on March 21, 1964, in the Corporation Court for the City of Danville, Virginia, for murder in the second degree.
