This is an appeal from a judgment rendered in favor of Merrel Kaley (Kaley) and against Catalina Yachts, a corporation (Catalina). Finding the appeal unmeritorious, we affirm the judgment.
The Incident
It was drizzling on September 21, 1978, as Kaley and Leonard Klatt, riding in a Kenworth tractor (the truck), came to the crest of a steep, downhill grade outside of Ozona, Texas.
