— On December 2, 2009, following an omnibus pretrial hearing in the above captioned matter, this court denied the defendant’s motion for suppression of evidence, but granted the *419motion for writ of habeas corpus with respect to the charge of fleeing or attempting to elude a police officer,1 and the matter was listed for trial. On March 9, 2010, after a one (1) day jury trial, the defendant was found guilty of count two (2) driving under the influence of alcohol.2
