In a proceeding pursuant to CELR article 78 to review a determination of the Zoning Board of Appeals of the Village of Farmingdale dated September 20, 2007, which, after a hearing, denied the petitioners’ application for an area variance, the appeal is from a judgment of the Supreme Court, Nassau County (Iannacci, J.), entered April 13, 2009, which granted the petition, annulled the determination, and directed the Village of Farmingdale to review the petitioners’ application based upon the relevant zoning law as it existed prior to a certain building moratorium enacted on June 5, 2006.
