This is an action brought by the plaintiff, John H. Fowler, against Todd A. Doran and others, alleging the existence of a mechanic’s lien and praying for the foreclosure of the same. The defendant Conservative Mortgage Company by cross-petition alleged that it was the *38holder of a mortgage upon the premises involved upon which was due the sum of $4,792.65 and prayed that said mortgage be declared a first lien on the premises.
