Plaintiff sued to recover damages for injuries -to 17- head of hogs which he placed in defendant’s loading pens for future shipment; and also for the loss of 103 other hogs by reason of the alleged negligent handling by defendant of the 17 hogs. Plaintiff asked for the sum of $2,-756,56.

The facts in the case are substantially as follows: The plaintiff in error, who will hereinafter be referred to as the defendant, is a common carrier of freight and passengers and operates a system of railways in this state and through the town of Soper.
