BROWN, District Judge.

This matter comes before the Court on Defendants’ Motion for Summary Judgment (# 8) and Plaintiffs Motion for Summary Judgment (# 12) as to certain claims.

Plaintiff asserts a civil rights claim under 42 U.S.C. § 1983 arising from Defendants’ conduct in responding to Plaintiffs efforts to obtain a building permit to develop certain property within the City of Warrenton. Plaintiff alleges Defendants’ conduct violated Plaintiffs procedural due process and substantive due process rights under the Fourteenth Amendment to the United States Constitution.…
