The defendant, Leck White, was charged by information in the district court of Murray county with the crime of driving an automobile while under the influence of intoxicating liquor, was tried, convicted and sentenced to pay a fine of $250 and costs, and has appealed.

When this case was called for trial counsel for defendant made the following motion:
