MILLER, District Judge.

This cause is before the court on the defendant’s motion for summary judgment, the plaintiffs motion for leave to file a second amended complaint, and the plaintiffs motion to extend the discovery deadline. For the reasons set forth below, the court addresses the summary judgment motion aimed at Ms. Humphrey’s ERISA claim as a motion to dismiss for lack of subject matter jurisdic tion, grants the motion to dismiss, grants the summary judgment motion, denies the motion for leave to file a second amended complaint, and denies the motion to extend the…
