On the 13th day of May, 1896, the decedent, Frida or Freída Maas, opened an account with the appellant, which is a savings bank organized under the laws of the State of New York, giving her residence as Twenty-third street, Lincoln place, West New York, N. J. She died intestate on the 15th day of November, 1898, at her residence in Guttenberg, in the county of Hudson, State of New Jersey, leaving her surviving a son and daughter, both minors and residents of the same place.
