— This is an action brought by the appellee against the appellant to recover damages in the sum of $40,000 for personal injuries alleged to have been inflicted by the negligence of the company. .Plaintiff alleged that his injuries occurred on November 10, 1907, while in the employ of defendant in its yards in San Antonio as a switchman and in the discharge of the duty of his employment, by stepping in a hole or rotten and defective place in the floor or platform of a car which defendant had negligently permitted to become and remain in such defective condition.
