The plaintiff was injured upon January 13, 1943 while operating a replaner, so-called, in the defendant’s mill at Rochester, when a board which he was planing was kicked back by the machine and struck him in the abdomen. From the defendant’s brief we quote the following description of the machine: “The planer consisted of a flat bed that can be raised or lowered to accommodate varying thicknesses of lumber and was 26“ wide.
